PHOTO SESSION CONTRACT
The contract is put into place so you know exactly what a session with Eye Sugar Photography entails and to ensure that I am able to deliver on your expectations. Please read all information carefully. If you have any questions, please let me know before the session. Thank you!
Due to the nature of custom photography, all sales are final. We do, of course, guarantee that the portraits you receive meet the highest standards in every respect and work with customers to approve designs and custom work before orders are placed. Payment of orders is due in full when the order is placed. Prints and products arrive 2-4 weeks after payment has cleared. Please allow up to 10 business days for checks to clear and four business days for credit cards. Albums and keepsake boxes take approximately 3-5 weeks as they are custom designed and hand made. Rush shipment is available on some items for an additional charge. All rates are subject to change at any time. In the interest of fairness to all customers, all rates are non negotiable unless booked through a special promotion.
The session fee is paid in advance to secure your chosen date. It is non-refundable should you cancel, but is transferable to another date in the event you wish to amend your booking with at least 48 hours notice. If less than 48 hours notice is given you will forfeit your deposit. If you feel there is a chance you may be getting ill please consider rescheduling in advance. Special consideration is taken in some cases in regards to rescheduling. The session fee does not include any images, either prints or digital negatives; these must be purchased separately. Many hours go into the preparation of your session, the session itself, editing of your images as well as your in-house ordering appointment and the final editing of ordered images and design time for custom products.
Your session payment must be paid by cash at the studio or credit card through our site or by phone if your session is less than two weeks from your booking date. You may also pay by check if booking more than two weeks from the requested session date.
If you need to reschedule your appointment more than 48 hours from your session date we would be happy to help. We do require your rescheduled date to be within 30 days of the original booking. If additional reschedulings are necessary after your first complimentary rescheduling you will forfeit your session fee.
Please keep in mind driving times and plan to arrive early for your session. This helps in reducing stress and makes for a pleasant session. We do schedule bookings with a bit of time between each but if you are 30 minutes or later to your session we will have to cancel your appointment. This is especially important for location shoots since lighting is so important.
You are responsible for covering additional fees and costs related to location choice (admission fees, parking, etc.). Travel up to 30 miles from 03878 is included. Time and travel above this will be invoiced (contact me for pricing). All locations that I recommend are within the travel time…so this does not apply to unless you have requested your own travel location.
Because some teenagers may have extensive acne I may not fully edit the images in the gallery due to time constraints but rest assured that images you purchase will have the acne fully edited. I will notify you if I feel the need to do limited editing in your child’s case. Even if there is extensive acne I will show you several images that are fully edited so that you know how the remainder will look when purchased.
If you have a request for a small change to an image, please let us know when you place your order. We can address minor changes at no cost (fix blemishes, tighter crop, airbrushing etc.), but more involved requests are billed at $25/hr. (An example of an extra charge will be for braces removal). We will let you know if there will be extra charges before work is begun. Once the requested changes are made, charges apply regardless if you choose to no longer have the edit in the final product.
Ordering sessions are set up for you to come view your images and make your purchase selections. We help in every way we can to help you create pieces of art for your home and assist with gifts and prints. Please be sure to arrive on time for your viewing. You are welcome to bring grandparents to the viewing as well. Please come ready to order. We block off a large chunk of time for your ordering session. If you do not order at your ordering session we do charge a $75 fee if are unable to order at this time and require another ordering appointment in the studio, by skype or by phone. All unordered images will be purged from our system one month from your session date. All 5x7s and smaller will be archived at the size purchased and all 8x10s and larger will be archived at the full size. Any archived images are available online or by phone for purchasing for no additional fee for a minimum of one year.
Credits and special offers are non-transferable and are not redeemable for cash.
Sometimes we are able to offer discounts on certain products due to a printer discount. These discounts are available at the ordering session only and cannot be offered after the ordering session due to availability. This includes specialty packages.
Please obey all copyright laws. Shalla Melton retains copyrights on all images (even those purchased on CD) and reserves the right to use the images and/or reproductions for display, publication, or other purposes. “All rights” pricing is available. Under no circumstances can a client use these images for profit, commercial endeavors, in competitions, or for professional display.
If you are gifted Facebook files with your order please obey all copyright laws by not cropping your image and making sure our logo is visible. Facebook strictly follows the copyright law and will remove images from your account if they believe you are using the images unlawfully. The Facebook files are gifted for social media use only and should not be printed. We do gift you with a facebook file for all purchased images. Please be sure to keep the logo visible where ever displayed.
If you purchase items that require design work, we will consult you first to get your input on the images, colors, text, etc. for the design. Try to be as specific as possible. We will then create a design doing our best to incorporate your requests. You can make up to three small changes to that design (change a color, change text, change out a picture). Additional changes will be billed at $25/hr. Again, we will let you know if there are extra charges before work is begun. Once the requested changes are made, charges apply regardless if the final product is purchased.
We choose the very best images for your gallery. Lighting, body positioning and facial expressions all effect the image and we choose to show you the cream of the crop. Having too many choices can be very overwhelming so we select our favorite images for your gallery. If you decide that you would like more options to choose from we can accommodate you for a $100 fee and a minimum $500 purchase agreement which must be paid in full prior to getting the images ready for you. This includes a second ordering session fee as you will need to come back a second time to view the additional images.
Events are run differently in that they are Limited Edition sessions with only a select number of spots available. Event fees are non-refundable but you may find someone to fill your spot if you so choose.
We reserve the right to reschedule a session or limited edition at any time due to photographer illness or weather. In the event of staff illness your session will be rescheduled with in 30 days of the original session date and will not be subject to any fees. We reserve the right to reschedule due to inclement weather. Heavy clouds may not result in rescheduling. We will contact you at least two hours prior if it is looking questionable to discuss the options.
Limited Events Policies
Limited Edition Events must be paid in advance to secure your spot. Limited edition fees are non-refundable. You may find someone to take your spot if you are unable to attend. Two drop in dates will be given for ordering sessions. If you are unable to attend one of the two provided dates, please contact us prior to the event so that we may schedule you as our schedule allows. If you do not attend your scheduled ordering session you will be subject to a $75 ordering fee and will forfeit your included prints. Special discounts available for limited editions are only available at our drop in ordering dates provided for that event. All ordering that takes place outside of these select ordering dates will be subject to current regular pricing.
In the event of inclement weather for an outdoor event, ESP reserves the right to reschedule. We understand that you may not be able to attend our rescheduled date. Please let us know as soon as possible so we may adjust time slots as needed. Your limited edition fee may be used for a custom session with ESP or towards a future limited edition only if you notify us on the original limited edition event date when canceled due to weather.
